In Florida when you are put on probation, you are advised of the rules and guidelines you must abide by while under probation. If you violate the rules, your probation may be terminated and you sent back to jail pending the results of a violation or bond hearing.


Probation violation proceedings are unlike other criminal proceedings in Florida. Most significant is that the burden of proof is "preponderance of the evidence" and not "beyond a reasonable doubt" as it is in criminal trials.  Further, in a violation of probation, otherwise known as a VOP hearing, the judge will hear your case, not a jury.


If you are found guilty of violating the rules of your probation, your judge can sentence you to the maximum penalty you faced prior to being put on probation, including prison or jail.
